Legal Question in Family Law in Florida

pre-nuptual

I am recently divorced and my

ex-husband is terminal. We had

a pre-nupital that said if we

divorced and if one of us died

the other would be able to live

in the home until death and the

property would then be split

up between his family and mine.

I would like to know if the

laws of the state overide the

pre-nuptial. Thank you
