Legal Question in Family Law in Florida

primary residential custody

When a child is sick while in the care of a Florida licensed daycare facility and a parent needs to be called to pick up the child, should the primary residential custodial parent be called first or the non-custodial parent? Should it matter who's visitation it is?

Thank you.

Re: primary residential custody

Assuming that the parents have Shared Parental Responsibility then the daycare can contact either parent. The daycare is not responsible to keep track of the visitation schedule only the well being and safety of the child. If the daycare contacts the parent who does not have visitation and this parent picks up the child then the parents should be glad that one was available to care for the child.
