Private Agreement

My ex and I had an attorney create a custody/child support agreement which we both agreed to and did not have the court ratify it. If my ex stops following the terms of the agreement, ie stops paying me what we agreed to, etc, or trys to take me to court later on to establish new terms, would the court consider the agreement we already had in place or would the judge act as if we never had an agreement? I have heard that once you have an agreement, that its hard to get it changed. I'm trying to decide whether to just have the court ratify the agreement we have in place already or just let it be until my ex doesn't want to follow it anymore. I would rather keep the courts out of it but I still want to feel protected. What am I risking by not having the court ratify the agreement we have now? We have never been married and have 1 child.

Best to get the court to enter an Order on your agreement. You ask what you face if you don't do this and just go to court if there is a breach. You could face many problems (too many to list here).
