Legal Question in Family Law in Florida

probate an estate

Is this something that can be done without a lawyer? My dad has passed away without a will and his legal wife who he left in March of 2007 (to get back with his ex wife) they seperated but no divorce. He passed away May 2007. She has taken his dead body away from us 5 times now so we had a memoral service with out it. Now she is tring to get every thing just because she has the wife power. Please help

If they never divorced, she is the next of kin and can make the decisions concerning the body. As for probate, anyone can file the will with the court. He may have appointed a personal representative in his will. If he didn't, anyone can petition to be the PR including you.
