Legal Question in Family Law in Florida

Procedures for legal separation while away from US

A friend of mine is currently married but separated from her spouse. She would like to get a legal separation and eventual divorce; but the problem is she and her spouse both live and work overseas (Bahrain). She has not shared the same residence with her spouse in over 6 months. Is there anything she can do legally to be separated while being overseas with out coming to the states? Or does she need to return to the states to file for separation and divorce? The marriage state was Florida, by the way.

Re: Procedures for legal separation while away from US

No, your friend must return to the U.S. and establish what the law calls a proper domicile(legal residence)in the state where she wishes to file for

the divorce. (However, if this person is going to continue living in Bahrain for many years to come, she may wish to consider filing for a divorce there, assuming that the divorce laws of this Islamic land would not be inimical to her rights as a divorcing woman.)
