what do I need to get text message subpoena from a cell phone? husband (no legally married but leaving for 9 years and have two kids). He claims that I'm crazy and that's why he's leaving.. but doesn't want to admit infidelity..I read three romantic messages on his cell.. I have phone bills with pages and pages of text messages with the same person but I'm not able to get content..

You'll need a Court to issue a subpeona duces tecum to the Telephone Co. to release those records. If you filing for custody you don't need "infidelity" as grounds. Maybe to bolster a claim for child support.
If you're not seeking to establish paternity and get custody from him do you really need the text messages? Could be expensive. You can call your carrier and see how much the charge will be.
