Prommisory note between husband and wife

My husband and I are purchasing a house together, I am putting up a large amount for a down payment. I feel the need for my husband to sign a prommisory note for his half of the downpayment. Is this legal? And will it hold up in case of divorse?

That seems to be a valid idea and should hold up in the event of a divorce.
