what is the property basis for buying out a house for purpose of a divorce

One spouse can buy out the other in exchange for taking other debt or assets, or if there is no equity in the house. A quit claim is usually used to accomplish this. When there is no equity, the spouse who has the ability to pay the mortgage should get the home and should also hold the other spouse harmless and indemnify him or her regarding any and all indebtedness on the property.
