Legal Question in Family Law in Florida
Property sale after annulment
My exwife and I had our marriage annulled earlier this month. As a part of the marital settlement agreement, it was agreed that I would pay half of the mortgage until the property that we purchased right after we were married sells. However, she has priced the property well above the appraised value and it is never going to sell at it's current price. My roommate is going to be losing their job so I am going to have to pay all of the rent and utilities and can no longer afford to pay half of the mortgage as well. What will happen to me if I stop paying that half? What can I do to force her to lower the price of the home?

You need to discuss with her the financial aspects of her demands for an unrealistic price. The selling price parameters should have been considered before you entered into your agreement. If she will voluntarily agree to modify her demands for a selling price as well as the terms of the settlement agreement, then that would be the best avenue for all. If not, you will probably have to go to court and seek the court's intervention.
