Put into the Income Deduction Order that he make an additional $95.76 payment towards arrearage for six months. (September-February) This would be $478.80 regular payment and $191.52 to arrearages for 6 months then $95.76 to arrearage.
My attorney is saying that would have to go back to court for contempt, since he did not pay and is not agreeable to the option I presented. What are my real options for collecting this since my attorney did not put the order through to the judge to sign? How can I propose that my attorney be responsible for fees and court cost since this is the result of his mistake? Can this be resolved without court or attorneys, but through the department of Revenue, since they handle child support cases?
