In our marital settlement agreement it states that I get 50% of the marital portion of his 401K and that I have the responsibility for the cost and submitting on notice to his attorney a QDRO in order to secure my intrest. Do I have to file something with the courts to do this or just hire a company to do this?

You need to contact a pension consultant who is familiar with this. He can then work with your attorney.
