do I need an attorney for a quadro or can I just fill out the form myself?

A QUADRO is a very complicated document which requires a tremendous amount of skill and tax knowledge. I seriously doubt that you could prepare one on your own. It is not a "fill in the blank" form which anyone can do.

Frankly, most attorneys (and CPA's) will NOT do QUADROs as they do not have the requisite knowledge either. You may need to pay a person who is skilled in drafting QUADRO's to prepare this for you.

What is necessary to divide a retirement account in a Rhode Island divorce?

A Qualified domestic relations order is a document which allows married couples to split their retirement accounts upon divorce without any tax penalties.

A Qualified Domestic Relations Order should be drafted by an attorney / Lawyer who is an expert in retirement accounts. A QDRO can also be drafted by an expert in drafting QDRO's.

After the QDRO is drafted it must be approved by the plan administrator and submitted to the judge for signature. It then must be entered and a certified copy must be sent to the plan administrator for implementation.
