Legal Question in Family Law in Florida
My question is can the custodial parent give either the grandparents or her ex boy friend any custody or power of attorney without the biological father's consent ? I pay childsupport and my name is on the birth certificate. The problem is I live in florida and my son lives in georgia. i went to the court out here in florida to see what rights i have as his father. When I went over the paperwork for my court order to pay childsupport,I have no right but to pay my childsupport. I want to take the mother to court so that i can put in a potition for joint custody so that I can have my rights as his father. He also has asked to live with me but i explain to him if thats how he feels, that his mom,me and him would have to all sit down and talk about it. I just built a relationship with him not to long ago because in the past her parents interfered with me seeing my son and i one point so did the mother. I would make a 3 hour trip when he was younger to spend time with him and there was always an excuse, either the grandparents were taking him somewhere or the mother would not let me spend time with him alone. Again i want to fight for joint custody but he resides in Georgia and i live in Floeida. I would like to know how do i go about filing for joint custody.

The case must be brought in GA.
If you bring the suit, you must go to the defendant. Therefore you must fill a Petition for Visitation and custody. The suit must be brought in GA
