Legal Question in Family Law in Florida

Hello I have a question. I'm engaged. I have a daughter by another man who is in prison, this man hasn't been in my life since I was 6 weeks pregnant. My fiance wants to adopt my daughter. I think legally her father still has rights. what should I do, or what is the best way to handle this situation. And how would I go about doing this?

If the bio dad is on the birth certificate then yes you must terminate the bio dad's rights. YOu will need to file a Petition to Terminate the Parental Rights of the father. Once those rights are terminated then you and your future husband can file the appropriate papers for adoption.
