Legal Question in Family Law in Florida

I was reading somewhere that a person cannot retire just to get out of paying alimony and child support. The article said if they were not of retirement age,the judge would not change the MSA on the support. My x went to an attorney said I am going to resign,he was told you can't do that,he was informed to retire instead..My x will be 56 this year(2011). I was awarded permament periodic alimony, because of the length of marriage 27+ yrs.I helped put him thru school and was a stay at home babysitter, not furthering my education. Will the judge take away my alimony, when I am taken back to court? Please answer this,I really do appreciate any input...This in case I have to get an attorney,I will be one answer ahead..Legal stuff is so scary....Thanks so much....

If he is not of retirement age, the Court may consider his "retirement" as a voluntary reduction in income, which would not warrant a reduction of alimony.

As of now, until he files the appropriate papers with the Court, there is nothing for you to do. Although it is not in my financial interest to advise this, I certainly do not believe that you should retain an attorney at this time.

An internet inquiry is no substitution for an in-office consultation with an attorney.

If your situation falls within the Greater Tampa Bay area, I would be happy to schedule you for a no obligation half hour office consultation. The main office is in Dunedin, with a satellite location in Tampa.
