Wife re-finances the house with husband. Husband gives her x$ of the refinance money. She then signs a quick claim deed. She then starts divorce process in which she and the husband agree that what is his is his and hers is hers and any further debt is seperate from both parties. Divorce is pending. Husband is now wanting to sell his house and indicated that the wife is still on the mortage and has to sign for permission to sell. Husband is also considering bankrupct. Wife is concerned what her liability is and if her current assets are liable?

If she is still on the mortgage she is still liable! Ask your attorney to draft a marital settlement agreement and order ASAP. If you need help e-mail [email protected].
