Legal Question in Family Law in Florida

I am recently divorced an my ex and I share custody 60 40. He and his live in girlfriend have constant arguments in front of our children and hers with swearing and her getting physical with their father. They just recently took our 2 kids and hers to the bch left my 11 yr old in the suv windows up no AC because he didnt want to go to the beach. My ex and his girlfriend argued on the drive home because she was calling my children names. The children informed me that she was hitting him swearing and causing him to swerve all over the highway. Once they got home my ex called me I had no knowledge of the arguments giving me my 1st right of refusal. He took the our boys to his parents and never came back or called. The boys told there grandparents about the argument and we are all very concerned. Again this is not the first time we have been informed of such issues at dads. I have been on the phone with my ex hearing his girlfriend and him fighting swearing etc as my ex mother in law has too. What can I do at this point I do not feel comfortable for my childrens well being when at dads any longer. I addressed what I heard about the Friday incedent and my concerns and he just said it wouldn't happen again. What can I do???

He obviously is acting like a lousy dad but, except for the thing about keeping your son in the car, he really hasn't done enough to get supervised visitation, in my opinion. You can give the motion a shot, but you should discuss it with a local lawyer who knows how local judges will react. Some judges will angrily through you out of court saying that this arguing isn't enough, others will tell him he has just one more chance to get his act straight with the kids. It will just depend on the judge. Find an experienced family lawyer in your area who knows the judges well.
