Legal Question in Family Law in Florida

When is it okay to refuse visitation ?

What circumstances must be present in order to refuse a father visitation of his 12 year old daughter? My daughter does not wish to visit her father due to her own reasons. I do not want her to visit due to the activities/actions that occur when she visits. We have no final judgements in regard to custody or visitation only an agreement signed and notarized by both parties. He hasn't paid child support recently

as well as has not abided by other points of our agreement. He told police that i was breaking a court order which prompted the police to visit & they left without enforcing

anything. the activities i spoke about involve drugs as well as other potentially dangerous acts.

Re: When is it okay to refuse visitation ?

It is a rare case that a court will deprive a parent of visitation. Just because that child complains dosen't allow you to interfere. It appears that she's in no danger of harm. A 12 year old is certainly old enough to discuss this type of matter with her Dad. You should obtain a court order prescribing your rights and responsibilities. There's no good reason that he shouln't pay support, eitherr.
