Refusing to be served

We have tried endlessly to serve my husband with divorce/child custody papers but he flat out refuses to sign for them and literally runs away from service. We were allowed to post the action on the newspaper. What happens now since he is not responsind and the notice expired today? Will I be able to get te divorce and gain my 7 yr old son's custody since he plays no part physically or financially on our sons life?

If what you did was a Notice of Publication and it was done correctly I assume, then you can go forward with the divorce. I believe in the Notice it told him the date/time of the final hearing, so set it down and go to it. Make sure you file the original notice and proof with the Clerk's Office under your Case No.
