Legal Question in Family Law in Florida
relocating with a child
I am the custodial parent & I have made the decision to move on with my life. I have found a wonderful man whom I have recently become engaged to. He is in the military & is stationed in another state & I want to move with my child to be with him. It would give me the opportunity to go to school & also allow my son to bond more with his soon to be step father. My X has had visitation with our son once in nearly 2 years & his family 7 times in the same period. So the visitation really wouldn't change any. It would just be a little inconvient if I wasn't living up the street from his parents. He is also in the military & lives in another state. I know that he needs to be served with a letter of intent to relocate however. I don't know how to put this together. I was wondering if you have like a template that I can model my letter from. I know that if it isn't worded right it is invalid & you can be brought up on kidnapping charges.

First, how did you become the custodial parent. If this happened in court, the best thing you can do is get back into court, explain the situation and adjust visitation, etc., so that you can have an amicable, equitable fair arrangement.
I have never heard of a "letter of intent" nor the template it flew in on.

The new relocation statute must be followed. I suggest you retain counsel.

You do have to go through the courts for this. Furthermore, it is not a typical letter that you can just write yourself and this action involves many documents. I would also suggest using an attorney. If you cannot do that, see what your local court can do for you as a pro se petitioner. But, without an attorney, you will not have representation to argue your side no matter what help they might offer...
