More on relocation....

Okay I got some of my answer with the statue 61.13001 but is there any chance of being granted a move if my daughter's father does pay his child support and she goes to his house twice a week and every other weekend even though it is usually with a member of his family (he works nights so HE doesn't see her much but his wife watches her) but she is very upset when it comes time for her to go to his house? The move is due to economic issues..if we stay bankruptcy is likely..does this have any effect with a judge?

Economic issues are important, but the two most important issues are:

1) Does the father pay his child support on time?

2) Does the father actually exercise his awarded visitation?

You may win on factor two, but he might just say that he can't help working nights.

The fact that your daughter cries may go against you. He may say that his relationship with his daughter is fragile, and your move will weaken it even further.

I should tell you that in the areas where my firm has offices (throughout central Florida), moves are almost never granted. I don't know about the rest of Florida, but I'll bet it's the same. You need to speak to a lawyer in your area to find out more.
