relocation with the child before Florida divorce

Hi. I am planning to relocate with my child to a different state in order to keep my employment. My husband and we are separated verbally agreed once to it but to give me hard time changes his minds every day. Child lives with me and I fullly suppor and provide for her. He doesn't pay child support, he riped financial affidavit that I gave him to fill out to calculate child support. Anyway, I am moving and is it true that he can not do nothing to stop me only if he gets a court order and that order he cna get only if he files for divorce? Thank you.

You are not forbidden from moving until some type of legal proceeding is pending. A minority of judges, though, have ruled that the child must be brought back to Florida if the divorce is filed by the other parent shortly after the move.
