Legal Question in Family Law in Florida

Relocation

I filed paperwork to relocate with my children to another state. My ex was given 30 days to object in writing but did not do that. I have checked with the court even after the 30 days and he has not objected. Does that mean I am free to move with my children. We have joint custody but I am the primary guardian.

Re: Relocation

If you served your ex with the paperwork (you're not supposed to file the paperwork with the court), and your ex did not respond to YOU in writing (notice I said to "YOU," not the court), you are free to move.

Be very careful, though, because it does't sound like you properly followed the statute. If you move without following the statute, you may very likely lose custody. Check with a family lawyer before you move.
