Legal Question in Family Law in Florida
Re-marraige and last name for spouse
I live in Florida and am about to get re-married. I have a large amount of debt from my previous marraige. Can my new spouse assume my last name or a hyphenated version without obligating herself to any of the current and/or past debt that I have incurred. I want to ensure that creditors can not harass her or touch any of her real, personal, or any other type of property just by using my last name. Also, what would happen if I were to file for bankruptcy after we were married. Thank you in advance for your response.

Re: Re-marraige and last name for spouse
Based upon the information provided, your new spouse is not responsible for the prior debt. The filing of petition in bankruptcy ( Chapter 7 ) will allow you a discharge to all your dischargeable debt. In some circumstances a chapter 13 filing may prove to be better.
