removal parental rights

if a married couple has a case plan; and the father is removed from the home and refuses to comply with ALL of the case plan but the mother is is in full compliance and awarded the kids back in to the home and decides to move out of state after the case is closed with her husband would she be breaking any laws or could she be punished for her actions?

She should wait until the case is closed, if unsure, she can just call her DCF contact and let them know her plans. As for the father, was he tpr'd?? If not, she has to provide him proper notice as required by statute of her plans to move and he will have a chance to object. This is a little complicated and she should seek an attorney to make sure it is done correctly. If she just takes off without letting the father know with the proper notice (and he has NOT been tpr'd) then yes, that would be unlawful and could cause her some problems.
