Request to Produce to a third party

I am in current litigation with my former husband who is about to be put in contempt for non payment of support for the 5th time in 2 years. He is claiming that I am responsible for him losing a job that he never really had. His brother-in-law ficticously put him on his payroll in order to ''help'' him and then allegedly fired him when I filed a Notice To Payor. My ex has now filed his 5th request for a downward modification of child support and has specifically blamed me for his unemployment. Can I ask my ex's brother-in-law (via a REQUEST TO PRODUCE) for proof of employment, payroll data, W-4's, etc? If so, how many days notice do I have to give him to comply?

No. You would have to serve a subpoena.
