Legal Question in Family Law in Florida
restraining order place on me permenantly
I had a order place against me for one year and ordered to go thru anger management class. I explained to the judge that I was getting out of the navy and going back home and he said very well, He the dropped the anger class and changed the 1 year to a permenant injunction. Can I clear my name from this and it it expensive to do.. I can't even buy a gun or hunt with a gun. I basically have no rights for no reason. I have neveer been involve with the police and I never touched my ex girlfriend in any way.

You will have to seek to vacate the order in court.
Re: restraining order place on me permenantly
You did not state when you got the injunction against you. First, you need to make sure the Judge declined to order you to take an anger mgmt. class. You can do this by reviewing your copy of the judgment or getting on line and checking with the clerk's office in that county.
If it has been one year since the entry of the judgment, the order would be terminated. You may try to seal the record. I have never attempted that for a client before so, I'm not sure if that is available.
If one year has not expired, you may file a motion to modify or terminate the injunction. This would not be that expensive for an attorney to handle.
In regard to your rights to buy a weapon, you need to check the statutes for the State you live in. You may need to provide a copy of the injunction judgment or see if your state allows you to petition for your right to buy a weapon.
'Hope this helps. Tom Rosenblum

Contact an attorney near the jurisdiction where the order was issued about having the order vacated.
