Legal Question in Family Law in Florida

Retirement plan

The divorce occurred in 2000. The current plan was funded 4 yrs post divorce, it is not marital. Can Judge still do a QDRO with these new funds?

Re: Retirement plan

A QDRO could still be done, valuing the funds at the time of the divorce and excluding the new, post-marital funds. Of course, if a claim for the retirement money wasn't made in the divorce, you probably can't go back and get the money now (unless the other party hid the account or the funds during the divorce).
