Legal Question in Family Law in Florida

Retro child support?

My x boyfriend was given a child support order based on a much lower childcare payment per month than what is truely being paid by myself. I told the judge that the payments would be going up by $260 a month within 2 days from the court date. The judge asked my x how much I was paying and he stated a much lower amount. I did not have any proof at the time of what I was going to be paying. If I went back to court could I get retro for the excess childcare that I have been paying? I literally began paying the higher amount 2 days after the child support case. I have receipts that date back to that day.

Re: Retro child support?

You do need to go back to court to get your child support raised, but you can't get the retroactive amount. You'll only be able to get the new amount going forward from the day you file for increased support. Of course, make sure you bring in the receipts for the day care to show the judge at the hearing.
