What are my rights as a father to keep my son until a court date to discuss scheduling?

If the child was not born in wedlock the mother is the natural and legal guardian of the child and the one with full custodial rights. Unless there is a court order granting you visitation (time sharing), you cannot just keep the child and she can call law enforcement to have you return him. Furthermore this will reflect poorly on you before the court.

If the court case is pending and there is a long wait until the final hearing, speak with an attorney who can assist you with filing a request for temporary time sharing (visitation) pending the outcome of the case.

Have you filed for visitation? Are you on the birth certificate? Are you paying court ordered child support? If not married, but on the birth certificate, then you have standing to file for visitation. I suggest you do so ASAP. If I can be of assistance, contact my office for an appointment 904-997-1031
