Rights for Non-Married

My mother was living in Florida with a gentleman for 15 years. He recently passed while they came to New York for the Holidays to visit us. We know about this gentleman but his family does not know us. Until the Funeral. His choice! Mom's stuff is still in Florida in a home they shared. He said the house was my mom's even if it's not on paper, Maybe he wrote it in his will. Can she just go there and get her stuff out? How can we find out if she was left anything in his will or if he has a will? What are her rights in this matter? Thank you!

Given the limited facts which you have provided, I do not understand why there is any question. If mom was sharing a residence with the deceased man, I would advise a client with a similar problem to continue to reside in the residence until someone raises an issue. Certainly, she can retrieve her personal belongings without fear of breaking any laws.

I am guessing that there may be more information which was not stated and, if so, you should review this matter with a competent attorney who is experienced in family and/or probate law.
