Rights of Seperated Parents

My Daughter( with her 20 month old daughter) resently left her husband and came to live with my wife and me. My Daughter wants a divorce and the husband is threatening to come and take the child. What are the rights of the mother and father of the child until an attorney is contacted. I don't want to get the local police involved if they can't stop the father from taking the child.

1. He cannot trespass on your property.

2. Start legal proceeding to determine cusody and visitation.
