selling a home while separated
My husband and I have been separated for 1.6 years and have a home together - he is trying to sell for a profit of 40,000 dollars and we have outstanding CC debt and I have two college loans totaling approx 15000.00. I want to be sure that these get paid. I now live in FL & he is in NJ. If I sign the papers, can he take the money & run?

Absolutely. Unless you have the proper safeguards in place including a written agreement which is provided in advance to the closing agent which directs the closing agent to pay these items out of the closing proceeds, you have no protection to ensure that your husband will pay off the obligations you have mentioned. You may be well advised to retain an attorney to make sure this happens.
