Legal Question in Family Law in Florida
I have been separated from my ex-husband for the last three years and we have been divorced since Sept 2009. He is ordered to pay child support in the state of Florida directly to me. He has a very hard time being respectful towards me. Calling me a bad mom and cussing at me whenever we speak on the phone. During the separation he did not assist financially with the kids whatsoever. After the divorce was final, he was ordered to pay 400 a month directly to me. Now he says he isn't going to pay me anymore. I know I can get the child support enforced. But is there a way to enforce good behavior? It states in our divorce papers that we are to treat eachother with respect and courtesy and he does not at all. I'm tired of the constant verbal abuse from him. and worry that his behavior is affecting the kids.

You're free to file a Motion for Contempt as to the terms encouraging respect and courtesy in the MSA and final judgment in light of shared parental responsibility, especially for the children's sake. However, it's up to you whether or not you want to go through the courts and spend money doing so. If it's bothering you so much as far as how he speaks to you on the phone, you might consider just limiting all communications to email. That way your communications are also documented should you decide to pursue this matter in court.
