Legal Question in Family Law in Florida

I have seperated from my husband and am in the process of filing for divorce. He has threatened me that he wont sign the papers if I move in with my boyfriend (whom I will be marrying after the divorce is final) we both live in florida and have an 18 month old little girl. We had our own verbal agreement as far as time shared and what we are splitting (which isnt much) all of that will be in the paperwork he's served with. What happens if he wont sign and get them notarized?? Can the divorce still be finalized?? Please help!!!!

It sounds like you and he have agreed to an uncontested divorce; if he refuses to sign the papers for an uncontested action it will need to be filed as a contested action. That means the Judge will make decisions.

File as a Contested Divorce, if he does not answer within 20 days, then file for a default.
