Legal Question in Family Law in Florida

In Sept of '08, we gave our attorney a $700 retainer fee,,However, she was never needed for the case as it was resolved without going to court..Now, she doesn't want to return the fee even though she provided no service..Is there anything governing this, or is it her option?

Take a look at your contract with the attorney. The contract may say that, once you pay the attorney, the money cannot be refunded. If you have no contract with her, she'd have to have a pretty good reason not to give you a refund. She have to provide you with a bill that shows the cost of opening up your case, speaking with you about handling the case, closing the file, etc.

Most contracts state non-refundable fee once paid. Read your contract.
