I recently filed for divorce. The only asset we need to divide is the house. I want 45% of the equity and appreciation. My husband thinks he should get even more because he had approximately $40k when we were married. He paid $12k just before we got married on my student loans. The remainder went to a house we bought a year and a half after getting married. We have no children. Is he entitled to anything more than 50% and should I be concerned if he hires an attorney?

Dividing property is a complex process where many different factors are taken into consideration. But the short answer is yes it is possible that he is entitled to more then 50%.
If your husband hires an attorney I would strongly suggest that you hire one as well. Other questions you need to ask are is their a current apprasial on the house? Do you want to re-finance and buy him out?

You should already have an attorney because he probably already has one. Your attorney will review the facts and tell you how you stand in this.
