Legal Question in Family Law in Florida

One Sided Divorce Agreement

Can I re-visit the terms of an existing divorce agreement, in which I did not employ an attorney and therefore, have signed off to many items which in hindsight were excessive? Lastly, given that the original divorce agreement was drafted in FL, and both parties currently live in IL, does either state benefit my chances as the husband to effectively change any of the original terms. (please note, if necessary I could move back to FL)

You are probably stuck. If the agreement was made and the Court accepted it in the FL divorce case you cannot change it unless there can be shown and proven some fraud, duress, coercion or mental problems (maybe).

I assume the case has not be transferred to IL so anything to be done will have to be done in FL at this point.

Re: One Sided Divorce Agreement

Hello. I am sorry that you have had to experience this. Since you and your ex now live in Illinois, you may

want to consider registering the divorce here, assuming there are continuing legal issues such as child support, children's tuition costs, etc. If no real issues exist and you still grieve from being short changed to the extent that you say you have been, your best bet would be to attempt to seek relief in Florida. Will be happy to discuss this further and in more detail.
