Legal Question in Family Law in Florida

I signed a waiver six years ago giving up my rights as benificiary to my husband pension when he dies.

We are now getting a divorce in the state of florida, can I still get half of his pension since he's not dead ?

That would depend on what is in the contract that you signed. If you only waived your right in the event of his death, then you are still entitled to half if you divorce.

It depends. Need to see what you signed but I would venture that we could force him to drop the waiver and/or pay you a lump sum settlement. Call for an appointment
