Legal Question in Family Law in Florida

Simple Divorce

My husband and I agree we want a divorce. We live in Fl.

We have come to an agreement of who gets what ect. with no arguments.

How long and how much truoble will it be to get divorced?

Re: Simple Divorce

Go to the Courthouse in the county where you live and see the Clerk of Family Court or, sometimes, the Law Librarian, who has the forms for a simplified divorce. They can assist you in filling out the forms, but they cannot dispense any legal advice. See a lawyer for that.

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

You can either purchase a package for an uncontested divorce and "do it yourself" or retain an attorney. Either way, it should be relatively simple if there is not any major property involved. If there is, then you should have a property settlement agreement drafted by a qualified attorney prior to filing the divorce. With an attorney, it could be completed in less than one month. Without, it is up to you to control the pace of the proceeding.

Re: Simple Divorce

If you agree, an attorney can prepare a settlement agreement and then it would be simple. You could then go to the courthouse and do it yourselves.
