Legal Question in Family Law in Florida

I am a single mother who will be moving to Hawaii very soon with my five year old son. His father doesnt pay child support,through the state,and we have a verbal custody agreement. He has our son every other weekend. I retain sole custody.

My question is this....Can I leave the state without his permission? Does he have any rights to our son? Since we were never married......Do I automatically have full parerntal rights and custody?

No, you need court permission to relocate.

do you have any paperwork filed in the court. If the two of you just agreed outside of the court system to establish visitation and he pays child support, I suggest you file for a court order to relocate.
