Legal Question in Family Law in Florida

I am a single mother of 2 year- old. I have never been married to the father of my child but his name is on the Birth certificate. I have been raising her by myself without any of his support and would like to obtain full custody. the father has history of drug use, violence, and has criminal records. I am a legal resident with visa and has stable job but not green card holder or citizen. if my visa expires, would i be able to take my daughter to my countly? how would I proceed this? and is it hard for me to get full custody?

You are not married so you have the right to do what you want until such time as he enforces his rights. Contact my office for free consultation 727-446-7659.

You already have full custody. As far as leaving the country with your daughter the pass port office will require the father's signature for consent. YOu will need to get approval from the court. This should not be a problem since he is not in the child's life. If I can be of assistance, please contact my office for an appointment. 904-997-1031

As a mother of a child who was not born in wedlock you are the natural and legal guardian of the child and can travel with the child as you like. You do not have to take any actions to establish full custody.

You will need his signature for the passport. However you can get a court order permitting travel with the child. See the below link:

http://travel.state.gov/passport/get/minors/minors_834.html

I will be able to assist with the Motion necessary for such a court order.

On a side note, if you need assistance with immigration (I am referring to the fact that your visa is expiring) I am also able to assist.
