sister died and brother in law is in a nursinghome

my sister called me on 9/7 she asked me to come to florida the help her with her financies. I arrived 9/9 and spoke with her on the phone that evening.She was in a nursing home recovering from a hip fracture. The next day she was on a ventilator at ORMC. She was transfered to another N.H. after leaving ORMC where she died a week later. She has 2 grown childen who are not aware what to do. My brother in law in a N.H. and is not able to make decisions. I was asked to pay for the funeral because my sister had no will. We are unable to access her account. We can not pay her bills. I want to be my brothers guardian and take him out of the N.H. and bring him to live with me in Texas. I also want to be the executer of his estate so he can live a comfortable like. My niece and nephew are willing to sign an agreement. Please tell me what I can do

You better check with a FL lawyer. If this were TX, an affidavit of heirship with disclaimers from the other heirs would work to get your sister's bank account. I don't know about FL probate law. You would also be better off to get appointed guardian of your brother's person and estate in FL and bring it to TX to take care of him. I think you're going to need a FL lawyer.
