My sister dies 9/30 my brother in law is in a nursing home
My sister called me on 9/7 requesting that I come to Florida to help her with her financies. I arrived on 9/9 and spoke with her that evening. She sound happy. She was in a nursing home recovering from a hip fracture. On 9/10 I went looking for her at the nursing home to find that they had sent her out 911 because the nurse said ''she did not look good''. I went to 2 hospitals and found my sister on a ventilator at ORMC. I do not know what happened to her at that nursing home. She was transfered to another nursing home after leaving ORMC and died a week later. My brother in law is in a nursing home, he suffered a stroke. I want to be his guardian and bring him to live with me in my home.
My sister has 2 grown children who do not want to care for him and I do not want him to spend in last days in a N.H. How can I become executor of his estate and obtain guardian ship

1. To become guardain you must petition the court where he resides.

2. Unless he has a will naming you Personal Representative, you can't.
