I have a situation where my ex wife and I have joint custody of the children. Ever since I have moved on with my life she has done nothing but speak negative things to my children, put restraining orders, emergency motions to prevent me from spending time with my children. She has been in contempt for disobeying the judges rules in our divorce papers.
I stayed with her for 6 years strictly for my children because she was never a good mother figure.
The children have said she smokes around them and second hand smoke is extremely dangerous for my children. I even receive complaints from the teachers at school how she interrogates the girls about what I do. She has even lied about what doctors have said regarding the children and I have copies of the doctor notes saying the contrary.
I really want to get sole custody because my ex wife has completly lost it and im afraid of my childrens mental health.

File a modification of custody, child support and visitation. Present you evidence in your modification and to the court. As the time of hearing you must have a physician or teacher present. Affidavits are acceptable only if the person is there to be questioned. Get a psycholigist for your children and have a report ready to be presented to the judge.
