Legal Question in Family Law in Florida

Sole Custody versus Shared Placement

It is my understanding that the state of Florida does not give "sole custody" to one parent if both parents are involved with the children. What is the law regarding "shared custody" with primary and secondary placement?

Re: Sole Custody versus Shared Placement

The language is Shared Parental Responsibility with usually one parent as the Primary Residential Parent. This means that the child or children will live will one parent and both parents share the parental responsibility. Such as important decisions regarding what school the children attend, doctor, hospital, religion. Keeping the non-residential parent current on the childrens academics, etc. In order for there to be sole parental meaning the children live with one parent and the other parent has no say about those important decisions and possibly no visitation or supervised visitation, it would have to be proven that it would be detrimental to the children for that parent to have parental responsibility or visitation. Detrimental would include physical abuse whether sexual or beating up the kids.
