Legal Question in Family Law in Florida

My son was born in Colombia (now is 16 years old) .

I moved to USA and married for first time and she gave affidavit to my son to come to USA.

I get divorce and then the mother of my son came from Colombia and I married her about 3 years ago, this married really never work. I want a divorce.

My son was not born during this marriage and we agree that he will continue to live with me.

We need to include him in this divorce?

That can be ordered in the divorce decree. You should speak with an immigration attorney regarding his status.

If both of you are resident of Florida then filing for divorce should not really be a problem. The problem will come in as to the status of your son. You need to check with an immigration attorney to be sure his status wil allow him to remain in the US
