Legal Question in Family Law in Florida
i have a son with a guy who I only dated for a short while. my son is 5 months old now and I am wanting to move to North Carolina from Florida to stay with my boyfriends mother, who will support us financially until we get back on our feet. My boyfriend lost his job recently and I am dependent on him. Ethans father has not paid any money in child support and at mediation we failed to agree to anything. Now I am looking at a court date sometime in November. Ethans father has Ethan about 2 days a week and is fighting for 50-50 that I dont want to give him. My lawyer told me that if i move right now than he can put an injuction against Ethan preventing him from moving away from the state of Florida. I find this hard to believe because nothing has been settled yet. He already put in an objection to relocate, but I did not even have to fill out relocation paperwork because timesharing has not even been set up in court yet. So whats the real deal?
