Legal Question in Family Law in Florida

My son is going on a mission trip to south Africa. I have had sole custody since he was born, he is now 17. The travel agent needs a consent form from the parents to leave the country and his father is refusing to sign. Is it necessary to have his permission? The father has never had any custody rights or visitation, and Lucas does not even have his last name. I never married the father. We have a passport for Lucas and he will be traveling with his Uncle to visit his grandmother. Please advise. Thanks so much!

not a problem. You can get a court order from the court allowing your son to leave.

I am surprized that the travel agent has a problem since this child has a passport. I would suggest you see the policy of the travel agent company before going to the expense of getting an order from the court. It would be about $250.00 or so depending on who you hire.
