Legal Question in Family Law in Florida

My son is 8 years old and was born in Florida. His biological father lives in South America (whereabouts unknown) and was not present for the birth and has not been in my son's life ever nor has he ever paid child support. He has never stepped foot in FL. We were never married and he is NOT on the birth certificate. I am now married for the past 4 years and my husband would like to adopt my son. Does the biological father have to be notified of the adoption and/or give some kind of consent?

You can file a Petition for Step Parent Adoption.

The biological father has to consent to an adoption by the step-parent, even though he has not been in the child's life. What is problematic is that you know who the father is. If you did not know, it may be less of a problem. Get to an attorney to discuss what needs to be done. Try to find the bio father and get his consent.
